Terms of Service

Pamphlet Box is currently in the process of company registration. Until incorporation is complete, this Platform is operated on an unregistered / proprietary basis. References to "Pamphlet Box" in these Terms refer to the business as currently operated, and will be updated to reflect the registered entity name, address, and CIN once incorporation is complete.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Pamphlet Box website and mobile application (together, the "Platform"), operated by Pamphlet Box ("we", "us"). By creating an account or otherwise using the Platform, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years of age and capable of entering into a binding contract under the Indian Contract Act, 1872, to use the Platform, whether as an Advertiser or a Promoter.

3. Description of the Platform

Pamphlet Box is a marketplace connecting businesses ("Advertisers") who wish to run hyperlocal advertising campaigns with individuals ("Promoters") who post campaign content to their personal WhatsApp Status in exchange for payment, subject to verification.

Pamphlet Box acts as principal in these transactions: Advertisers purchase an advertising service from Pamphlet Box, and Pamphlet Box separately engages and compensates Promoters for the display service they provide. Pamphlet Box is not merely an intermediary or broker arranging a direct contract between Advertisers and Promoters.

4. Account Registration and KYC

You must provide accurate and complete information when creating an account. Promoters must complete KYC verification (including PAN and bank/UPI details) before receiving any payout. Pamphlet Box may suspend accounts with incomplete or inaccurate KYC information.

5. Advertiser Terms

5.1 Campaign Creation

Advertisers define a campaign radius, budget, and price per verified view at the time of campaign creation. Pamphlet Box may provide suggested ranges but the Advertiser is responsible for the final parameters chosen.

5.2 Payment and Invoicing

Campaign amounts are payable in advance and are inclusive of Pamphlet Box's platform fee and applicable GST, disclosed in full before payment. Current commission tiers are described at [link to current pricing page].

5.3 Refunds

Where a campaign concludes with an unspent budget, the Advertiser is entitled to a refund of the unspent amount, processed via refund voucher or credit note as applicable under GST law, and credited back to the original payment method or source.

5.4 Content Standards

Advertisers are solely responsible for the legality, accuracy, and appropriateness of campaign content, and must comply with the ASCI Code for self-regulation of advertising content and all applicable Indian advertising law. Pamphlet Box may reject or remove campaign content that violates these standards or that involves prohibited categories, including but not limited to unlawful goods or services, and misleading health or financial claims.

6. Promoter Terms

6.1 Subscribing to Campaigns

Promoters may browse and subscribe to campaigns visible to them based on location. By subscribing, you agree to post the provided content to your WhatsApp Status faithfully and for the duration specified in the campaign.

6.2 Verification Window

You must submit screenshot proof of your Status views within the verification window specified for each campaign (currently the final hours of the 24-hour posting period). Submissions outside this window may not be eligible for payout.

6.3 Payment and Tax Withholding

Verified earnings are credited to your in-app ledger, net of applicable tax deducted at source (TDS) under Section 194-O of the Income Tax Act (or its successor provision), in accordance with the prevailing rate and threshold. You may withdraw your ledger balance to your bank account or UPI at any time, or, where offered, choose to redeem it via BBPS bill payment or gift voucher through our licensed partners.

6.4 No Self-Dealing

You may not subscribe to a campaign you have created as an Advertiser, and you may not coordinate with other accounts to generate artificial or fraudulent views. Pamphlet Box may withhold payment, suspend accounts, and pursue recovery where such conduct is identified.

7. Third-Party Platform Disclaimer (WhatsApp)

The Platform facilitates the posting of content to WhatsApp Status, a service operated by WhatsApp LLC / Meta Platforms, Inc., which is not affiliated with Pamphlet Box. You are solely responsible for complying with WhatsApp's and Meta's own terms of service and policies when posting content. Pamphlet Box does not control WhatsApp's or Meta's policies, cannot guarantee that your account will not be restricted, suspended, or banned by WhatsApp or Meta as a result of using the Platform, and is not liable for any such action taken by WhatsApp or Meta. By using the Platform, you acknowledge and accept this risk.

8. Prohibited Conduct

  • Submit fraudulent, manipulated, or misleading screenshots or verification materials
  • Create or use multiple or fake accounts
  • Attempt to manipulate view counts or campaign metrics
  • Post content that is unlawful, defamatory, obscene, or otherwise violates applicable law or these Terms
  • Circumvent Pamphlet Box's payment or verification systems

9. Fees and Commission

Pamphlet Box charges a commission on Advertiser campaign spend, disclosed in full at the time of campaign creation, and may charge a fee on withdrawals as disclosed at the time of withdrawal. Current rates are published at [pricing page link] and may be updated from time to time; changes will not apply retroactively to campaigns already funded or earnings already credited.

10. Intellectual Property

The Platform, including its design, branding, and underlying technology, is the property of Pamphlet Box. Advertisers retain ownership of their campaign content but grant Pamphlet Box and Promoters a limited license to display and distribute it for the purposes of the campaign.

11. Limitation of Liability

To the maximum extent permitted by law, Pamphlet Box's liability arising from your use of the Platform is limited to the amount paid by you (if an Advertiser) or credited to you (if a Promoter) in the campaign giving rise to the claim. Pamphlet Box is not liable for indirect, incidental, or consequential damages.

12. Indemnification

You agree to indemnify and hold Pamphlet Box harmless from any claims, losses, or damages arising from your breach of these Terms, your campaign content, or your violation of applicable law.

13. Suspension and Termination

Pamphlet Box may suspend or terminate your account for violation of these Terms, suspected fraud, or as required by law. You may close your account at any time; outstanding, verified earnings will be paid out subject to completion of KYC and applicable withdrawal processes.

14. Dispute Resolution and Governing Law

These Terms are governed by the laws of India. Disputes shall be subject to [exclusive jurisdiction of the courts of [city] / arbitration — to be finalized with legal counsel].

15. Grievance Officer and Consumer Complaints

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and applicable IT law, complaints may be directed to our Grievance Officer:

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the Platform or via email before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
